Consumer court: Warrants issued for not appearing before court

A consumer court issued bailable arrest warrants of a shop proprietor who has not appeared in court, despite being summoned.

The proprietor Nadeem of Quraishi Centre has been summoned by the court in a Rs200,000 damages suit. The suit has been filed by a petitioner who says that Nadeem got a laptop – that he had purchased from him – repaired locally instead of Dubai.

Petitioner Muhammad Atif says that on July 28, 2012 he had purchased a Dell laptop for Rs46,500 from Nadeem, who gave him a one-year warrantee.

Nadeem also charged him an extra Rs4,000, saying that the money would be used to send the laptop to Dubai in case it developed a fault.

Atif has claimed that a few weeks after the purchase, the laptop malfunctioned and he gave it to Nadeem for repairs, who assured him that the computer would be sent to Dubai. A few days after, Atif again visited the shop and learnt that the respondent had gotten the computer repaired from a local shop.

He told the court that the seal of the laptop had been removed and the equipment ruined by the local mechanic. Atif says he protested before the respondent but he did not pay heed to his protests.

He has asked the court to award him Rs200,000 in damages for causing him mental agony.

Talking to The Express Tribune Nadeem denied that the laptop had been repaired locally. He said it was sent to Dubai. The repairs took four days, after which he returned it to the petitioner, he said. Atif, said Nadeem, had then asked him what would happen if the laptop malfunctioned again.

He said he had told him that he would get it repaired from a local mechanic free-of-charge if that happened.
